The Administrative Procedure Act
What is rulemaking? During this session, the faculty discuss rulemaking, types of rules, and the purposes of rulemaking procedures. Faculty then examine the elements of proposed and final rulemaking notices, what happens inside the agency, and the public's role in the process.
The Small Business Regulatory Enforcement Fairness Act of 1996 upped the ante for federal agencies by giving small entities--small businesses, small nonprofits, and small government organizations--a right to appeal a final rule under the Regulatory Flexibility Act which requires extensive economic analysis and other considerations to rulemaking. Learn how this law transforms the process for small entity input through the Small Business Administration's Office of Advocacy, small entity representatives to interagency panels for occupational safety, environmental, and financial laws, and the final arbiter, Congress.
This session covers how best to influence a federal regulatory agency. How do you advocate that your position is in the public interest? Learn how to effectively use scientific, economic, and programmatic data to support your position, and how to use public relations and the media to influence public opinion to achieve your desired result.
How to use Internet resources to track current and potential regulations or conduct regulatory research. A case study tracks the rulemaking process.
